From the use of MERS, a company which supposedly has the right to transfer and assign mortgages and notes, to the mass securitizing of home loans, these unorthodox practices provide substantial legal defenses to your foreclosure.

Lenders, in a rush to close loans, sold “predatory loans,” loans that the lenders knew that homeowners could never pay back, with deceptive terms like adjustable rates and negative amortization terms. These deceptive and unfair practices provide a wealth of defenses which can be used to keep you in your home.

Although under contract to comply with the Making Home Affordable Program (HAMP), many banks still illegally refuse to do so. MODIFYING YOUR LOAN

As you likely have heard, banks will do anything and everything to deny you a loan modification. Often, they will simply flatly refuse to apply governmental programs which they are obligated to comply with.

Many of these programs, such as the Home Affordable Modification Program (HAMP), give the bank a lot of “wiggle room,” where they can deny you for your modification. So, it is vitally important that what you submit to the bank be complete, accurate, and that the numbers and figures you are providing to them add up to the numbers that the banks require.

Do NOT simply give your paperwork to the bank. It is vital that you make sure you understand what figures the banks are looking for, and what figures and financial information qualifies you for the HAMP modification program.

For example, you may have too much income to qualify. You may not have enough. You may have too many monthly bills or expenses. Your spouse’s income may assist you, even if she isn’t on the loan, but if he/she assists you too much, you may be disqualified for HAMP. Bills that appear on your credit report but you aren’t paying need to be explained. Profit-loss statements need to be demonstrated if you are self-employed.
